By booking a tour or safari (“the Services”) with Trabybes Adventure Safaris (“the Company,” “we,” “us,” “our”), you (“the Client,” “you,” “your”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms constitute a legally binding contract between you and Trabybes Adventure Safaris.
2.1. Booking Process: A booking is considered confirmed only upon our written (email) confirmation and receipt of the required deposit.
2.2. Deposit Requirement: A non-refundable deposit of 30% of the total tour cost is required to secure your booking, dates, and relevant permits (e.g., gorilla trekking permits, park entries).
2.3. Permit Security: For itineraries requiring specific permits (gorilla, chimpanzee, etc.), the full permit fee is required as part of the initial deposit and is subject to the refund rules of the respective national authority.
3.1. Final Payment: The remaining balance of the tour cost must be paid in full no later than 60 days prior to the tour start date.
3.2. Late Bookings: For bookings made within 60 days of departure, full payment is required immediately upon confirmation.
3.3. Payment Methods: We accept bank transfers and secure online payments. All transaction fees are the responsibility of the client.
All cancellation requests must be received in writing. Refunds are calculated as follows:
More than 60 days before departure: Loss of deposit.
59 to 30 days before departure: 50% of total tour cost is forfeited.
29 to 0 days before departure: 100% of total tour cost is forfeited.
No-Show or Early Departure: No refund will be given.
Note: Gorilla and chimpanzee permits purchased on your behalf are 100% non-refundable at any time, as per government regulations.
Requests for changes to a confirmed itinerary must be made in writing. While we will endeavor to accommodate changes, we cannot guarantee them. Any changes may incur administrative fees and additional costs for revised services, accommodations, or permits.
6.1. Itinerary Variations: We reserve the right to alter itineraries, accommodations, or transportation due to operational logistics, weather, road conditions, or park authority directives. Suitable alternatives will be provided.
6.2. Force Majeure: The Company is not liable for failure to perform obligations if caused by events beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, pandemics, or significant changes in government travel advisories.
6.3. Cancellation by Company: In the unlikely event we must cancel a tour (excluding Force Majeure), you will be offered a full refund or credit toward a future safari.
7.1. Travel Insurance: Comprehensive travel and medical insurance, including emergency evacuation coverage, is MANDATORY for all clients. Proof of insurance may be requested.
7.2. Health & Fitness: You are responsible for ensuring you are medically fit for the activities booked. Consult your doctor regarding required vaccinations and anti-malarial precautions.
7.3. Documentation: You are responsible for possessing a valid passport (with at least 6 months validity beyond your return date), necessary visas, and vaccination certificates (e.g., Yellow Fever).
7.4. Conduct: The Company reserves the right to terminate a client’s tour, without refund, for conduct deemed dangerous, disruptive, or illegal. You are liable for any damages caused to property, vehicles, or equipment.
8.1. Limitation of Liability: Trabybes Adventure Safaris acts as an agent in arranging accommodations, transport, and activities. We are not liable for injury, loss, damage, accident, delay, or irregularity caused by any third-party service provider.
8.2. Assumption of Risk: Participation in wildlife safaris, trekking, and adventure activities involves inherent risks. By booking, you voluntarily assume all risks associated with such travel.
8.3. Maximum Liability: Our maximum liability, for any claim whatsoever, is limited to the total cost paid for the tour.
We are committed to protecting your personal data. Information collected is used solely for booking purposes and will not be shared with third parties except as required by service providers (e.g., hotels, airlines) or by law. Please see our full Privacy Policy for details.
Should you have a complaint during your tour, you must immediately inform your guide and our office to allow for prompt resolution. If the issue remains unresolved, a formal complaint must be submitted in writing within 30 days of the tour’s completion.
These Terms and Conditions are governed by and construed in accordance with the laws of [Country of Operation, e.g., Uganda, Kenya], and any disputes shall be subject to the exclusive jurisdiction of its courts.
